Vorige week heeft de rechtbank Midden-Nederland (voorzieningenrechter in Utrecht) in kort geding geoordeeld dat een werknemer gehouden is een mondkapje te dragen, indien de werkgever dat met een beroep op het instructierecht ex art. 7:660 BW van hem verlangt. Bij niet naleving van de redelijke instructies mag de werkgever het loon opschorten en de werknemer op non-actief stellen zo lang niet wordt voldaan aan de opgedragen verplichting.
